This?position?will?be?located?in?either?Guangzhou?or?Shanghai?and?reports?to?China?Legal?Director?(based?in?Guangzhou)?of?the?Legal?and?External?Affairs?Department?in?a?multinational?company.
2.??Main?Responsibilities:
？ Provide?legal?support,?advice?and?counsel?in?practical?business?terms?to?various?business?function?of?the?company?in?China,?ensure?business?goals?are?met?in?a?way?that?complies?with?applicable?laws?&?regulations?and?corporate?requirements.
？ Support?China?Legal?Department?to?fulfil?the?overall?functional?responsibility?with?relatively?little?supervision.
Detailed?Responsibilities:
? Contract?Review?and?Negotiation?-?Monitor?and?improve?process?for?contract?development,?review?and?maintenance;?advise?all?levels?of?business?functions?including?Marketing,?Sales,?HR?and?others?on?a?broad?array?of?business?transactions;?update?and?develop?standard?documentation?in?order?to?protect?company’s?best?interests?on?contractual?commitments,?balance?and?optimize?risks,?gain?greater?commercial?benefits?and?ensure?company?is?protected?legally.
? Review?of?marketing?materials?and?communication?materials?–?Review?those?marketing?and?communication?materials?and?ensure?the?best?interests?of?the?company?are?protected.
? Litigation/Claims/Government?Investigation?-?Initiate,?defend?and?settle?of?claims,?demands?and?litigations?throughout?China?market;?monitor?compliance?with?the?claims?policy?and?procedures?and?progress?of?court,?employment?arbitration?proceedings,?and?other?regulatory?investigation?in?order?to?limit?the?Company’s?payouts?to?legitimate?and?enforceable?claims?and?ensure?the?Company’s?rights?are?protected.
? Training?–assist?China?Legal?Director?in?providing?various?trainings?for?China?employees?with?regards?to?the?corporate?requirements?and?company?policies.
? Assistance?–?Assist?China?Legal?Director?in?implementation?of?the?Company’s?investment?and?strategy?project;?prepare?relevant?legal?documents?in?order?to?allow?business?to?take?advantage?of?opportunities?and?optimize?risks.
3.?Knowledge,?Skills?&?Experience:
A. Bachelor?of?law?degree?or?above?from?either?a?fine?domestic?university?or?preferably?an?overseas?university.
？ Admitted?to?PRC?lawyer?qualification?in?China.
？ Have?a?minimum?of?5?years?professional?experience,?which?should?include?time?working?in?a?leading?local?or?international?law?firm?and/or?within?the?legal?department?of?a?multinational?corporation.
？ Have?knowledge?of?the?cosmetic?or?direct?selling?industry?is?not?mandatory?but?would?be?an?advantage.
？ Have?professional?skills,?including?good?communication,?and?multicultural?interpersonal?skills.?The?ability?to?formulate?creative,?practical?legal?and?business?solutions?and?to?play?strong,?positive?roles?independently?and?on?multiple?business?or?country?management?teams?with?minimal?supervision?will?be?critical.
？ Have?integrity?and?the?ability?to?build?trust,?process?management,?ability?to?present?or?take?(as?appropriate)?decisions?in?a?timely?fashion.
？ Language?proficiency?must?be?fluency?(both?spoken?and?in?writing)?in?English?and?Mandarin.
